(Transcribed by Joan S Dunn) Deed Book 1 A Page 51, 52, & 53 Henry Newkirk To Joseph Canady Deed of 150 acres of lands This indenture made this 30th day of December in the year of our Lord one thousand seven hundred and eithty & in the fourth year of our Independence, between Henry Newkirk of the County of Duplin and State of No. Carolina of the one part, and Joseph Canady of the same County & State aforesaid of the other part, Witnesseth that the said Henry Newkirk for divers good causes and considerations him thereunto moving but more especially for and in consideration of the sum of thirteen pounds current money to him in hand paid or secured to be paid before the sealing & delivery hereof the receipt whereof he doth hereby acknowledge and himself therewith to be fully satisfied and contented & therof and therefrom doth hereby acuit the aforesaid Joseph Canada his heirs executors administrators and assigns, hath bargained sold enfeoffes conveyed and convirmed & hath by these presents for himself his heirs executors & administrators hath & doth fully freely and absolutely bargain sell enfeoff convey & forever confirm unto the said Joseph Canada his heirs and assigns one certain tract or parcel of land containing by estimation one hundred and fifty acres lying & being in the County of Duplin on the east side of the North East River and north side of Limestone Swamp. Begining at a maple in the edge or the Swamp at Anthony Lewis'es line, thence as his line North thirty five East one hundred and sixty pole to a pine his corner, thence So. 55 Et. 103 pole to a stake, thence So. 66 poles to a pine Thankfull Hicks'es corner, thence along her line So. 127 poles to a white oak pine & gum her corner straight to the begining, which said one hundred and fifty acres of land was granted to Henry Newkirk by Richard Caswell, Esqr. Capt. General Governer in the cheif in and over the said State, by a pattent bearing date July the first one thousand seven hundred and seventy nine & conveyed from him the said Herny Newkirk to Joseph Canada to have & to hold the said one hundred & fifty acres of land and premises with the appertenances unto the said Canada his heirs & assigns forever in as full and ample manner to all intents & purposes as he the said Henry Newkirk did might or could have held the same before the making hereof, and the said Henry Newkirk doth hereby promise & engage for himself his heirs executors and administrators that at the time of sealing & delivery hereof that he the said Henry Newkirk is and stands seized of the said land and premises of an indefeazeble estate of inheritance in fee simple & hath in himself good right full power & lawful authority to grant bargain sell convey and forever confirm the said land and premises & every part & parcer thereof with their and every of their appertenances unto the said Joseph Canada his heirs & assigns and that from time to time and at all times forever hereafter he the said Joseph Canaday his heirs & assigns by power and withno hereof may and shall enter into have hold cede occupy possess and forever enjoy the said one hundred and fifty acres of land free and clear & freely and clearly acquitted discharged saved kept harmless & idemnified of and from all former or other gifts grants bargains sails exfeoffments with intails jointers dowers execution extents and incumbrances whatsoever moreover the said Henry Newkirk doth for himself his heirs executors & administrators do promise and engage that at any time hereafter at the reasonable request of him the said Joseph Canada his heirs or assigns or at his and their cost and charges in the law make or cause to be made and duly executed any further or other deed or instrument of writing for the sames making a good and lawful title of the said one hundred & fifty acres of land & premises to him the said Joseph Canaday his heirs & assigns forever as he the said Joseph Canada his heirs or assigns or their counsels learned in the law shall advise devise or require, and further more the said Henry Newkirk doth hereby covenant & agree for himself his heirs executors & administrators to & with the said Joseph Canada his heirs & assigns to warrant & forever defent the title of the said one hundred and fifty acres of land to him the said Joseph Canada his heirs or assigns free from the claims of him the said Henry Newkirk his heirs, executors administrators or assigns or any other person or persons whatsoever laying any lawfull claim thereunto. In witness where of the said Henry Newkirk hath hereunto set his hand & seal the day & year first above written. Henry Newkirk Signed sealed & delivered in the presence of us Robert Southerland Abraham Newkirk State of No. Carolina, Duplin County, July Court 1784.
