George Mallard To Daniel Mallard Deed 16 July 1787

(Transcribed by Diane Siniard) Deed Book 1 A Page 423, & 424 George Mallard To Daniel Mallard Deed for 100 acres lands This indenture made this sixteenth day of July one thousand seven hundred & eighty seven & eleventh year of our Independency Between George Mallard of the one part & Daniel Mallard, both of the State of North Carolina County of Duplin, planter, of the other part. Witnesseth, that he the said George Mallard for and in consideration of the sum of fifty pounds current money of this State to him in hand well and truly paid, the receipt whereof he doth hereby acknowledge & himself therewith fully contented & paid hath given granted bargained and sold, and by these presents doth give grant bargain & sell unto the said Daniel Mallard his heirs and assigns, certain piece of parcel of land lying & being in the County of Duplin, on the west side of the No. Et. River on Turkeypen Branch. Begining at a chinkapin tree at the River swamp, thence runing No. 36 Wt. 30 chains 64 links to a gum in a swamp, thence So. 64 Wt. 31 chains 64 links to the seutune of three pines, thence So. 36 Et. 31 chains 64 links to a large red oak in a swamp & thence to the first station, containing one hundred acres as by patent doth appear. To have & to hold to him the said Daniel Mallard his heirs and assigns forever, as also may more fully appear to have and to hold to him the said Daniel Mallard one other tract or parcel of land containing two hundred acres, lying in the County & State aforesaid, between the mouth of Persimmon & the grove swamp. Begining at a red oak on John Mallard's line, thence So. 30 Et. 120 poles to a maple, thence So. 60 Wt. 160 pole to a red oak by Charles Ward's line, thence as Ward's line So. 30 Wt. 50 pole to a gum his corner thence as Ward's other line So. 50 WT. 100 pole to a water oak by Horse Branch, thence up the branch No. 25 SWt. 72 pole to a water oak, thence No. 20 Et. 160 pole to a pine on his own line, thence as his own line So. 36 Et. 75 pole to his corner, thence as his other line No. 64 Et. to the begining. To have and to hold the aforesaid two tracts of land with the appurtenances & all rights previledges & improvements to the same in any wise belonging to him the said Daniel Mallard his heirs and assigns forever & that the said George Mallard for himself his heirs & assigns doth hereby covenant & agree to & with the said Daniel Mallard that he the said Daniel Mallard his heirs and assigns, shall & may forever hereafter peacebly and quietly have hold occupie possess & enjoy the aforesaid, granted two tracts of land and premises without the let or molestation of any person whatever & free & clear and freely & clearly from & against of manner of incumbrances whatsoever & the said George Mallard doth oblige himself his heirs executors & administrators to warrant & defend the aforesaid granted two tracts of parcels of land & to him the said Daniel Mallard his heirs and assigns forever, against the claim or claims of all persons whatsoever. In witness whereof he the said George Mallard have hereunto set his hand & seal the day and year above written. George Mallard Signed sealed & delivered in the presents of William Southerland Elijah Mallard Phill Southerland State of No. Carolina Duplin County July Term 1787.
