Ephraim Strickland & Tabitha his wife To Wm Swinson & Andrew J Swinson
Deed 1/2 acre of Rail Road at Stricklands depot
This Indenture made this Fifteenth day of October (AD) one Thousand Eight hundred & thirty
eight Between Ephraim Strickland and Tabitha Strickland of the County of Duplin State of
North Carolina of the one part and William Swinson and Andrew James Swinson of said County
& State of the other Part Witnesseth that the said Ephraim & Tabitha Stricklin hath bargained
and sold and forever set over unto the said William Swinson and Andrew Janes Swinson a certain
tract or parcil of Land for and in consideration of the sum of Twenty five dollars in hand
paid by the said William Swinson and Andrew James Swinson to the said Ephraim Stricklin and
wife Tabitha Stricklin before the signing sealing and delivery of these of these presents
which Land is Bounded as follows Begining at a Stake on the west side of the Wilmington &
Raleigh Rail Road Sixty five feet from the Centre of said Road & near the North Margin of
the Lisbon Road and Runs North 18 degrees west Two Chains and seventy six links to a Stake
then south 72 west one chain & Eighty five links to a black jack tree then south 18 degrees
East two chains and seventy six links to a stake in the North Edge of the Lisbon Road then
North 72 Et to the Begining containing half an acre to have and to hold to them the said
William Swinson & Andrew James Swinson Their Heirs and assigns to the only proper use and
behoof of the said William Swinson and Andrew James Swinson and the said Ephraim Stricklin
& Tabitha Stricklin doth for then selves their heirs and assigns warrant & forever defend
the said land & premises to them the said William Swinson and Andrew James Swinson from and
against the lawful claim or claimes of all and every person or persons whatsoever by these
presents In witness whereof the said Stricklin and Tabitha Stricklin his wife hath hereunto
set their hands and affixed their seals the day and date above written Signed sealed and
delivered in presence of

To William Wells & Gibson Sloan Esqrs greeting whereas William Swinson and Andrew James Swinson
lately recovered in our Court of please & quarter sessions held for the County of Duplin at the
Courthouse in Kenansville on the 3rd Monday in July 1839 produced a deed in said Court from
Ephraim Strickland and wife Tabitha for one half acre of land on the Rail Road and produced the
saim to be duly proved in said Court by the oath of Gibson Sloan one of the subscribing witnesses
thereto and it appearing to the satisfaction of the Court that the said Tabitha Strickland is so
unwell that she cannot conveniently travel to the Court to be examined privately relative tot he
Execution of said Deed these an therefore to command you to go to the said Tabitha Strickland if
she cannot conveniently come to you at any time you may think fit and then and there Examine the
said Tabitha seperate and a part from her said Husband Ephraim Strickland wheather or not She
Executed said deed with her own free will and consent without any fear or compulsion of her said
Husband Ephraim Strickland and the said Examination being plainly written on said Deed or on some
paper attached thereto you are to return to our Cour of Please and Quarter Sessions sealed up under
your seal and proper Signatures Witness James Dickson Clerk of said Court the 3rd monday in July
1839 & 64th year of our independence

In compliance with the above commission to us directed Gibson Sloan & WIlliam B Wells did on the
17th day of Decr one Thousand Eight hundred & thirty nine at the House of the said Tabitha Strickland
seperate & a part from her Husband Ephraim Strickland proceeded to Examine her Relative to the Execution
of the within attached deed to William & A. J. Swinson who acknowledged she did assign said deed freely
willinly and without any constraint of her husband E Strickland or any other person whatsoever given
under our hand & seal the 17th day of Decr 1839

The Execution of the within deed having been duly proved in opin court of July term 1839 by the oath of
Gibson Sloan a subscribing witness thereto & a commission having issued by order of court to take the
Private Examination of Tabitha Strickland Relation to the Execution of said deed at this term the same
is returned and the deed commission & private Examination are ordered to be registered
