Elijah Bowen To Meshack Stallings
Deed for 200 acres lands
This indenture made this fifteenth day of April in the year of our Lord one
thousand seven hundred & eighty six. Between Elijah Bowen of the County of Duplin &
State of North Carolina of the one part, & Meshack Stallings of the same State & County
aforesaid of the other part Witnesseth, that the said Elijah Bowen for divers good
causes & considerations him thereunto moving but more especially for and in consideration
of the sum of one hundred and forty pounds specied to him in hand paid, the receipt
whereof he doth acknowledge himself therewith to be fully satisfied & content, and
thereof and therefrom doth hereby acquit the aforesaid Meshack Stallings, his heirs
executors administrators & assigns, hath bargained sold enfeoffed conveyed and confirmed,
and hath by these presents for himself his heirs executors & administrators & assigns
hath doth fully freely and absolutely, bargain sell enfeoffe convey & forev er confirm
unto the said Meshack Stallings, his heirs and assigns, one certain tract of parcel of
land containing by estimation two hundred acres be the same more or less, situate lying
& being in the County of Duplin on the upper end of Benjamin Fussel's land. Begining
at a stake in his cornfield, thence So. 2 Wt. 40 poles to a pine, thence So. 88 Et. 66
poles to a pine, thence No. 2 Et. 242 pole to a pine, thence No. 88 Wt. 146 pole to a
gum in Fussels Creek, thence to the begining. To have and to hold the said two hundred
acres of land and premises with the appurtenances unto the said Meshack Stallings his
heirs & assigns forever, in as full and ample a manner to all intents & purposes as he
the said Elijah Bowen did might or could have held the same before the making hereof,
& the said Elijah Bowen doth promise & engage for himself his heirs & assigns that at
the time of sealing & delivering hereof that he the said Elijah Bowen is & stands seized
of the said land and premises of & indefeazable estate of inheritance in fee simple, and
hath in himself good right full power & lawfull authority, to grant bargain sell convey
and forever confirm the said land and premises & every part and parcel thereof, with their
and every of their appurtenances unto the said Meshack Stallings his heirs and assigns,
and that from time to time and at all times forever hereafter, he the said Meshack Stallings
his heirs & assigns by power and virtue hereof may and shall enter unto, have hold use
possess and forever enjoy the said two hundred acres of land free and clear and freely and
clearly acquitted discharged saved kept harmless & indemnified of and from all former or
other gifts grants bargains sails enfeoffments wills intails jointures dowers executions
entents & incumbrances whatsoever, the taxes which shall hereafter annually become due
(only excepted) moreover the said Elijah Bowen doth for himself his heirs executors & a
dministrators, do promise and engage that at any time at the reasonable request of him the
said Meshack Stallings his heirs & assigns, or at his or their cost and charges in the law
make or cause to be made and duly executed any further or other deed or instrument of
writing for the sure making a title to the said land and premises, to him the said Meshack
Stallings his heirs and assigns forever, he the said Meshack Stallings his heirs or assigns,
or his or their councils learned in the law shall advise devise or require, and furthermore
the said Elijah Bowen doth hereby covenant and agree for himself his heirs executors &
administrators to and with the said Meshack Stallings his heirs and assigns to warrant and
forever defend the title of the said two hundred acres of land to him the said Meshack
Stallings his heirs or assigns executors or administrators, or any other person or persons
whatsoever. In witness, whereof the said Elijah owen hath hereunto set his hand & seal
the day & year above written.
