Ebenezor Garrison To John McGee
Deed for 135 acres lands
This indenture made the second day of June in the eleventh year of American
Independence & in the year of our Lord Christ one thousand seven hundred & eighty
seven. Between Ebenezor Garrison, planter, of the State of North Carolina & County
of Duplin of the one part, & John McGee of New Hanover County and nigh Wilmington
of the other part witnesseth, that the said Ebenezer Garrison for divers good
causes and considerations him thereunto moving, but more especially for the valuable
consideration of the sum of thirty pounds current money of the State aforesaid to
him in hand & thirty paid by John McGee aforesaid, before the ensealing &
delivering of these presents receipt whereof is hereby acknowledged, the said
Ebenezor Garrison doth by these presents grant bargain sell alien & confirm unto
the said John McGee or his heirs and assigns forever, one certain tract or parcel
of land containing by estimation one hundred & thirty five acres, lying & being
in the County of Duplin & State aforesaid, situated and lying & being on the east
side of the North branch of Cape Fear River, & on it certain branch of Muddy Creek,
Known by the name of Marsh Branch, it being the south of said Marsh Branch.
Begining at or near a small black gum or stake below a small Branch, runing into
the marsh branch and mill pond, thence up the south east side of the said small
branch by a row of marked trees unto a pine, in the back part or line of John Magee,
bearing date the 22 day of December 1775, thence the said line to a small black
corner, thence to stake in the branch, thence down said branch to the station.
To have and to hold the said plantation or tract of land containing one hundred
and thirty five acres be it more or less. To have and to hold the aforesaid land
and premises with all its improvements, to the same belonging or in any wise
appertaining, of every nature or kind whatever, free from all former gifts grants
mortgages whatever, given granted or done by him the said Ebenezer Garrison or
any person or persons whatever, by from or under him or them or any of them, and
the said John McGee the aforesaid land & premises shall and may have hold use
occupie aceipt enjoy & possess as his own free and lawfull inheritance, free
from all incumbrances whatever, & further more pureged & said Ebenezor Garrison
the aforesaid land and premises to him the said John McGee his heirs and assigns,
shall and will warrant & forever defend from and against him the said Ebenzer
Garrison his heirs and assigns, as also from and against the just & lawful claim
of all & every other person or persons whatever, who may hereafter lay any lawfull
claim to the same. In witness the said Ebenzer Garrison hereunto set his hand
seal the date above written.
