Deed for 379 acres Land
This Indenture made the third day of April in the year of our Lord One Thousand Eight
Hundred and thirty two between David Carr, Barnet Carr James Carr Jacob Carr by his
agent James Carr John Carr Wm. L. Carr David J. McCanne and his wife Susan McCanne
James T. Boney and his wife Elizabeth Boney levinia Carr John Gree of the State of No.
Carolina and County of Duplin heirs at law of the real Estate of Joseph Carr Junr. Decd.
Of the one part and John Mallard one of the said heirs of the State and County aforesaid
of the other part Witnesseth that for and in consideration for the sum of about fifteen dollars
to each heir in hand pad or secured to be paid by the said John Mallard the recipt where
of is hereby acknowledged by the said David Carr Barnet Carr James Carr Jacob Carr
by his agent James Carr John Carr William L. Carr D. J. McCann and his wife Susan
McCanne James J. Boney and his wife Elizabeth Boney Sivina Carr John Greer and we
the said heirs do by these presents bargain sell and convey to the said John Mallard
two certain tract or parcels of land situated in the said County of Duplin partly on the
waters of Maxwell Swamp and futches Branch they being lands bequeathed to the said
Joseph Carr by the last Will and testament of his gather John Carr Decd. And in
consequence of the death of the said Joseph Carr the aforesaid two tracts of Land have
decinded to the aforesaid heirs at law the first tract buted and bounded as follows
Beginning at a pine and two white oaks Saplings in the fork of futches branch Casons corner
thence Crooms line No. 45 Et 127 poles to a pine stump in Thalleys line on the edge of
the main road thence Thalleys line So. 45 Et 193 poles to a dead pine the corner on the
west side of Futchs branch pocosin thence Thallleys other line So 45 332 poles to a
dead pine the corner thence Thalleys other line No. 45 Wt 92 poles to a pine allin corner
at the mouth of worthless meadow branch thence as the branch about No. 6 Et 110 poles
to a pine on the west side of the branch thence crossing the branch No. 30 Et 119 poles
to the beginning containing by estimation three hundred and forty nine acres be the same
more or less. Also one other tract of land lying on the South side of Maxwell Swamp
it being lands patented by the said John Carr Decd. Patent patented by the said John Carr
Decd patent bearing date the eight day of October one thousand Eight hundred and twelve
beginning on the South side of Maxwell Swamp at a black gum at said Carrs other corner
on Chasons line on the main run of Maxwell Swamp running then with Chasons line So 26
Et 70 poles to a stake Chasons corner then with James Harvels line So 18 wt 29 poles to
a lightwood stump his corner thence with boneys old Line So 50 wt 74 poles to a water oak
on the run of Maxwell Swamp thence down the meanders of the said run to the beginning
containing by estimation thirty acres making in the whole three hundred and Seventy nine
acres be the same more or less and we the aforesaid heirs at law of the Estate of the
said Joseph Carr decd. Do each for ourselfes our heirs Executors administrators &c each
heir the eleventh part of said land & it being the equal distribution Share of each heirs
warrents and defend the right of the aforesaid two tract of land to him the said John Mallard
his heirs Executors administrators and assigns forever together with all and singular its
appurtenances hereditiments &c there unto belonging in witness whereof we the said heirs
do hereunto set our hands and seals day and date above written.
