David Cannon To John Gibbs
Deed for 85 acres lands
This indenture made this eleventh day of April in the ninth year of the America
Independence, and in the year of our Lord one thousand seven hundred and eighty five,
between David Cannon Junr. of the Coutny of Duplin in the State of No. Carolina of the one
part, and John Gibbs of the same place on the other part. Witnesseth, that the said David
Cannon for and in consideration of the sum of twenty pounds current money of the State of No.
Carolina to him in hand well and truly paid by the said John Gibbs the receipt whereof he doth
hereby acknowledge, and himself therewith to be fully satisfied contented and paid and of every
part & parcel thereof, doth acquit and discharge the said John Gibbs his heirs executors and
administrators forever by these presents, he the said David Cannon hath given granted bargained
sold aliened enfeoffed conveyed confirmed assigned and set over, and by these presents for
himself his heirs executors and administrators doth fully freely and absolutely give grant
bargain sell alien enfeoffe convey confirm assign and set over unto the said John Gibbs his
heirs and assigns forever, all that piece or parcel of land situate lying and being in the
County of Duplin aforesaid on the north side of Goshen Swamp joining the middle run of said
swamp, and lying between the mouth of Cowhole branch & the mouth of white oak branch. Begining
at a white oak in the swamp at the run the upper corner of Dennis Foley's survey & runs with his
line No. 20 Et. 90 pole to a red oak John Gibb's corner at the mouth of Cowhole swamp, thence
with Gibb's line Wt. 60 pole, thence No. 65 Wt. 80 pole, thence No. 20 Wt. 20 pole, thence No.
65 Wt. 78 pole to a Beech and white oak his corner at the mouth of white oad branch, thence
along said Connaon's new line So. 35 Wt. 42 pole to a black gum on one of the runs in Goshen
Swamp, and thence down the said run as it meanders to the begining and containing in the whole
eighty five acres of land & all houses buildings improvements woods ways waters & water courses
profits commodities hereditaments & appurtenances to the said premises hereunto granted or any
part thereof belonging or appurtaining and the reversion & reversions remainder and remainders
rents issues and profits thereof and also all the estate right, title interest, use trust
propirty claim and demand whatsoever of him the said David Cannon of in and to the said
premises, and all deeds evidences and writings touching or in any wise concerning the same.
To have and to hold the land hereby conveyed bargained and sold and every part and parcel
thereof with thier and every of their appurtenances unto the said John Gibbs his heirs and
assigns forever, to the only proper use and behoof of him the said John Gibbs & of his heirs
and assigns forever, and the said David Cannon for himself his heirs executprs and administrators,
doth covenant promise and grant to and with the said John Gibbs his heirs and assigns, by these
presents that the said David Cannon now at the time of sealing and delivering of these presents
is seized of a good same perfect and indefeazable estate of inheritance in fee simple of and in
the premises hereby bargained & sold, and that he has good power and lawfull authority to grant
and convey the same to the said John Gibbs in manner and form aforesaid, and that the said
premises now are and forever hereafter shall remain and be free & clear of and from all and all
manner of former gifts grants bargains sales & judgments and from all and all manner of troubles
whatsoever made done committed or suffered by the said David Cannon or any other person or
persons whatsoever, the rents & taxes thereon now due and hereafter becoming due to the State
only excepted and the said David Cannon and his heirs all and singular the premises hereby
bargained & sold with the appurtenances unto the said John Gibbs and his heirs & assigns against
him the said David Cannon & his heirs & assigns shall warrent & forever defend by these presents.
In witness whereof the said David Cannon hath hereunto set his hand & seal the day and year
first above written.
