David Cannon To James Morris
Deed for 421 acres lands
This indenture made the twenty ninth day of December in the eleventh year of the
American Independence Anno Domini one thousand seven hundred and eighty six, Between David
Cannon of the County of Duplin and State of North Carolina, planter of the one part, &
James Morris of the same place on the other part witnesseth, that the said David Cannon
for & in consideration of the sum of three hundred pounds current money to him in hand well
and truly paid, before the sealing and delivery of these presents, by the said James Morris,
the receipt whereof he doth hereby acknowledge, and himself therewith to be fullu satisfied
contented and paid, and of ev ery part and parcel thereof doth acquit and discharge the said
James Morris his heirs and assigns forever by these presents, he the said David Cannon hath
granted bargained sold aliend conveyed & confirmed, assigned & set over and by these presents
for himself his heirs executors & administrators doth fully freely and absolutely grant
bargain sell alien convey confirm assign and set over unto the said James Morris his heirs &
assigns forever sundry tracts or parcels of land, situate lying and being in the County of
Duplin aforesaid, on the South side of the North East on a branch thereof called Rattle Snake
Branch, which several tracts or parcels of land an bounded as follows, to wit, one piece of
land lying on the south side of the No. East swamp in the fork of Rattle Snake Branch.
Begining at a small pine in a branch below Anthony Jones's field, and runs So. 81 Wt. 81 poles
to a red oak and marked pine, thence No. 20 Wt. 186 poles to a white oak, thence No. 45 Et.
20 pole to a stake in Rattle Snake Branch, thence down the swamp to a marked gum at the mouth
of a Branch, thence up the branch to the begining, containing by estimation one hundred and
twenty one acres, be the same more or less, it being part of a survey of three hundred acres
formerly granted by patent to John Cannerly, bearing date the 2nd day of April 1751, which
land being desended from the said John Connerly to his son Cullen Connerly, and since conveyed
by the said Cullen Connerly by a deed of bargain & sale to Jesse Barfield, and afterwards sold
and conveyed by the said Jesse Barfield to Constantine Whitfield, reference being thereunto
had may more fully appear, & also one other piece or parcel of land lying and being in the
County of Duplin aforesaid on the south side of the No. East on Rattle Snake Branch. Begining
at a white oak on the side of Rattle Snake Branch, runing thence So. 24 Wt. 180 poles to a
pine, thence No. 66 Wt. 90 poles to a black jack, thence No. 24 Et. 180 poles to a pine, thence
to the first station & containing one hundred acres be it more or less, it being land that was
formerly granted to Edward Rollings by patent bearing date 29 September 1753, ulation being
thereunto to had may more fully appear, also one other piece or parcel of land lying and being
in the County of Duplin aforesaid & adjoining the aforesaid last mentioned tract & is bounded
as follows, to wit. Begining at a pine a corner tree a corner tree of his former survey near
Rattle Snake Branch, & runs So. 21 Wt. 180 pole to a pine, thence No. 71 Wt. 180 pole to a pine,
thence along a line of marked trees to a white oak on a little branch, thence down the said
Branch to a pine his corner, thence to the first station, containing one hundred acres which
was formerly granted to Solomon Barfield by patent bearing date the fifteenth of March 1756,
relation being thereunto had may more fully appear, the said last mentioned two tracts of land
was sold & conveyed by a deed of bargain and sale from William Graddy & Jesse Bearfield to
Constantine Whitfield, reference being thereunto had may more fully appear, & also one other
tract or parcel of land lying and being in the County of Duplin aforesaid, on the south side of
Rattle Snake Branch and joining the lines of the other lands hereby granted, being part of a
tract of land of 200 acres which was granted to Constantine Whitfield by a patent bearing date
the 24th day of May 1773, all which four pieces of land containing in the whole four hundred
and twenty one acres be the same more or less, was conveyed from the said Constantine Whitfield
to his daughter Rachel Goodman by deed of gift bearing date the 24th day of September 1778,
and was since conveyed by a deed from Henry Goodman & Rachel his wife to Timothy Goodman, and
afterwards conveyed b y the said Timothy Goodman to the said Henry Goodman by a deed of gift
bearing date the 26th day of October 1778, & since by the said Henry Goodman sold and conveyed
to Stephen Bearfield by a deed of bargain & sale bearing date the 25th day of October 1785,
and since by the said Stephen Barfield sold and conveyed to David Cannon by deed of bargain &
sale, bearing date the 16th day of November 1785, reference to which several sales & conveyances
being had may more fully & at large appear, and now by these presents sold and conveyed by the
said David Cannon to the said James Morris. To have and to hold to him the said James Morris
his heirs and assigns forever, all the within bargained and granted four pieces or parcels of
lands & appurtenances. Together with all houses buildings improvements thereon with all woods
waters & water courses, ways previledges benefits & advantages whatsoever thereon or thereunto
in any wise belonging or appertaining, in as full & ample manner as he the said David Cannon by
his deed for the same could or might enjoy & the said David Cannon for himself his heirs
executors and administrators doth hereby covenant & grant to and with the said James Morris his
heirs executors adms. or assigns shall & may from time to time & at all time forever hereafter
lawfully peacebly and quietly have hold use occupie possess or enjoy all & singular the said four
pieces or parcels of land & premises with their & every of their appurtenances free and clear
and freely & cflearly discharge off & from all and all manner of former or other gifts grants
bargains sales leases and mortgages wills jointures dowers right & title of dower & from all
manner of incumbrances whatsoever, (except the yearly rents or taxes thereon hereafter becoming
due and payable to the state, & the said David Cannon doth further covenant & agree to & with the
said James Morris to keep harmless & indemnified him the said James Morris his heirs executors
and administrators in the quiet & peaceble possession of all and singular the said hereby bargained
& granted four pieces or parcels of land & premises, from and against the just & lawfull claim of
him the said David Cannon his heirs executors & administrators and from and against the just and
lawfull claim & demand of all and every other person or persons whatsoever. In witness whereof
the said David Cannon hath hereunto set his hand & seal the day & date above written.
