Daniel Glisson Shef. To William Hall
This Indenture made the Nineteenth day of October in the fifteenth year of American
Independence and In the year of our Lord one thousand seven hundred and ninety. Between
Daniel Glisson Esquire High Sheriff of Duplin County in the State of North Carolina of
the one part and William Hall of Bertie County In the State of North Carolina of the
other part whereas the States Writ of Vendicione Exponas and Fieri Facias Issuing from
the County Court of Cumberland in the following countasuit State of North Carolina to
the Sheriff of Duplin County Greeting we Command you that of the Goods and Chattel Lands
and tenements of the Estate of James Lockhart already leavied on in the hands of Elizabeth
Lockhart Administrix if to be found in your Bailiwick you cause to be made the sum of
one hundred Eighty seven pounds one shilling and four pes. which was lately in our County
Court of Pleas and Quarter Sessions held for Cumberland County at the Court House in
Fayitteville adjudged George House for damages also six pounds ten shillings for cost and
charges in the said suit expended whereof the said Jameses Estate is liable as appears to
us of Record and have you the said Moneys besides your fees for this service before our
said Court at Fayetville aforesaid on the fourth monday in October next then and there to
send withsaid Court the damages Costs and charges aforesaid & herein fail not and have you
then and there this writ Witness John Ingram Clerk of the said Court the 31st day of July
in the 15th year of the Independence of the said State Anno Domini 1790. By virtue of which
said writ the Sheriff did proceed to see a certain tract or parcel of Land already levied
on in the hands and possession of Elizabeth Lockhanrt administratrix as aforesaid and Claimed
by her for the Heirs of the said James Lockhart by virtue of a deed of Gift from the said
James Lockhart to James Lockhart and Lillington Lockhart his sons in two separate parcels on
the East side of the No. East river and on Limestone Creek which Deed is bearing date the
first day of October in the year of our Lord 1782. And containing in the whole One Hundred
and Thirty Acres which bein so levied on the said Sheriff in pursusance of the duty of his
said Office and Virtue of the writ aforesaid did advertise according to Law and expose the
said Lands for sale at Public vandue on the 15th day of October in the year of our Lord 1790
aforesaid, and on the same day did convene a Jury of good and Lawfull men of the County of
Duplin on the premises to Determine the property of the said Lands, which said Jury upon their
Oath did Determine and adjudge that the said Lands so levied upon by the aforesaid writ of
fieri fiacras might in Justice to be sold to discharge the said Executios whereupon the said
Sheriff did proceed to sell the Lands aforesaid which are bounded as follows to wit. One
hundred acres more or less situate lying and being in the County of Duplin in the State of
North Carolina on the East side of the North East River below Limestone Creek joining & between
Atkinses other tract and Gillespie Begining at a water oak on the bank of the River the mouth
of Limestone Creek the said Atkinses other corner and Gillespies and runs Et 80 poles to a
pine, thence No. 70 Et. 200 poles to a pine on the north side of Maple Branch thence So 20 Wt
92 pole to a pine in his other line thence So 57 Wt 190 pole to a pine the begining containing
one hundred acres more or less by Patent on Record doth appear bearing date the 19th day of
April 1760. Granted to John Atkins, And also one piece or parcel of Land containing thirty or
forty acres more or less on the East side of Limestone Creek being part of a tract granted to
the said John Atkins by patent and by the said John Atkins to Anthony Miller by Deed, including
the mils and mill seals & as of Record may appear and the said Jury having adjudged the said
Lands to the liable to Discharge the said Executions the sheriff proceeded to sell the same
according to Law and the said William Hall appearing on the premises on the day aforesaid did
bid of the said two pieces or parcels of Land containing one hundred and thirty acres more or
less at the sum of sixty two pounds current money and wat the last and highest bider now this
Indenture Witnesseth, that the said Daniel Glisson sheriff of Duplin County by virtue of and
in pursuance of his said office and the writ aforesaid and for and in Consideration of the
sum of sixty two pounds Current money to the said Daniel Glisson in hand paid before the
sealing and delivery of these presents the receipt whereof the said Daniel Glisson doth hereby
acknowledge, hath Granted, Bargained, Sold, aliend Enfeoffed assigned set over conveyed and
confirmed by virtue of his said office and in pursuance of the writ aforesaid, as fully as he
can and is thereby Empowered and enabled Doth by these presents grant bargain and sell alien
enfeoffe transfer assign and soever convey and confirm unto the said William Hall all the
aforesaid two peices, tracts or parcels of Land situate lying and as before mentioned with
all the woods, waters, profits and advantages whatsoever tothe said Land and every part and
parcel thereof belonging and all the Estate Right Title Interest Claim or Demand of the said
James Lockhart or of his said sons James and Lillington therein. To have and to hold the
said one hundred and thirty acres of Land, mentioned or intended to be Granted, sold, aliened,
transfered set over assigned, conveyed and confirmed unto the said William Hall his Heirs
and assigns forever to the only proper use b enefit and behoofe of the said William Hall his
heirs and assigns forever, or as full and ample a manner as he the said Daniel Glisson sheriff
of Duplin County aforesaid, by virtue of his office of Sheriff and in Execution of the writ
aforesaid and is hereby Enabled to convey alien transfer and change the same and the said
Daniel Glisson doth covenant promise and agree to and with the said William Hall his heirs
and assigns that he the said Daniel Glisson sheriff of Duplin County aforesaid, will warrant
and Defend the said Granted and bargained premises unto the said William Hall his heirs and
assigns against the said Daniel Glisson and his heirs and assigns against the said Daniel
Glisson and his heirs and against every other person or persons claiming under him the said
Daniel Glisson his heirs or assigns so far as he is Empowered and enabled by virtue of his
said office of Sheriff and in pursuance of an Act of the General Assembly of this State in
such case made and provided. In witness whereof the said Daniel Glisson hath hereunto set
his hand and seal the day and year first above written.
