Charles Ward To Charles Brown
Deed for 330 acres lands
This indenture made the twenty eighty day of March in the year of our Lord one
thousand seven hundred & eighty eight. Between Charles Ward in the County of Duplin in
the State of North Carolina of the one part & Charles Brown of the same place of the
other part Witnesseth that the said Charles Ward for & in consideration of the sum of
one hundred pounds current money of the State of North Carolina, to him in hand well &
truly paid by the said Charles Brown before the sealing & delivering of these presents,
the receipt whereof he doth hereby acknowldege & himself therewith to be fully satisfied
contented & paid & of every part and parcel thereof doth acquit & discharge the said
Charles Brown his heirs executors & administrators forever, he the sdaid Charles Ward
hath given granted bargained sold aliened conveyede confirmed assigned & set over & doth
fully freely & absolutely give grant bargain sell alien convey confirm assign & set over
unto the said Charles Brown his heirs & assigns forever, all that piece or parcel of land
& plantation lying & being in the said County of Duplin on the east side of Nahunga Swamp,
between the two mirey branches, being part of the land the said Charles Ward bought of
David Murdock. Begining at an ash on the run of Nahunga at the mouth of the upper Mirey
Branch, & runs up said Branch as the run meanders 110 pole to the forks of the said branch,
then up the east prong of the said being Christopher Newtins boundary to a white oak on
the back line, thence No. 33 Et. 28 pole to a black oak, thence No. 58 Wt. 42 pole to a red
oak, thence No. 72 to a pine, thence No. 66 Et. 100 pole to a pine, thence No. 34 Et. 130
pole to a red oak in Charles Ward's line, thence No. 31 Wt. 46 pole to a pine in the lower
mirey branch, thence down said branch Wt. 76 pole to a black gum on the run of Nahunga,
thence up the said run as it meanders to the begtining, containing in the whole two hundred
& thirty acres be it more or less, also one other tract or parcel of land lying & being in
the County of Duplin & State of No. Carolina aforesaid & joining on the eas side of the
aforesaid 230 acres of land hereby bargained & sold it being part of the said Charles Ward's
new survey. Begining at a red oak Charles Ward's corner & runing thence So. 31 Et. 50 poles
to a pine, thence So. 30 Wt. 230 pole to a pine & water oak in Wolf pond branch, thence down
the said branch to a white oak Christopher Martin's corner, thence along said Charles Browns's
own line No. 33 Et. 28 poles to a black oak, thence No. 58 Wt. 43 pole to a red oak thence
No. 72 poles to a pine, thence No. 66 Et. 100 poles to a pine, thence No. 34 Et. 130 pole to
the begining & containing in the whole one hundred acres of land more or less. To have & to
hold to him the said Charles Brown his heirs & assigns forever, all the within granted &
bargained two pieces or parcels of land & plantation, containin in the whole three hundred &
thirty acres be the same more or less. Togeather with all houses buildings improvements & all
previledges benefits & advantages whatsoever thereon or thereunto in any wise belonging or
appertaining, in as full and ample manner as he the said Charles Ward by his deed or grant for
the same could or might enjoy & the said Charles Ward doth hereby covenant promise & engage to
& with the said Charles Brown his heirs & assigns, that at the time of sealing & delivering
these presents, he the said Charles Ward is the true sole & lawful owner of all the above
bargained lands & premises, & hath in himself good right full power & lawfull authority to
sell & convey the same away to the said Charles Brown in manner & form as aforesaid & further
the said Charles Ward for himself his heirs executors & administrators doth promise & agree to
& with the said Charles Brown that he the said Charles Brown his heirs & assigns shall & may
from time to time & at all times forever hereafter by force & virtue of these presents lawfully
peacibly & quietly have hold use occupie possess & enjoy all & singular the within granted &
bargained two pieces or parcels of land & premises with the appurtenances aforesaid without the
least lett hindrance molestation or interuption of him the said Charles Ward his heirs executors
or adms. or of any other person or persons whatsoever & further will warrant secure & defend
forever the said Charles Brown his heirs executors administrators & assigns int he quiet &
peacible possession of all & singular the above bargained two tract of land and premises from
& against the just & lawful claim of any other person or persons whatsoever claiming by from or
under him them or any of these & rite title interest or property whatsoever of in and to the
said premises or any part or parcel thereof. In witness whereof the said Charles Ward hath
hereunto set his hand & fixed his seal the day and date first above written.
