(Transcribed by Joan S Dunn) Deed Book 1 A Page 526, 527, & 528 Charles Mumford To Robert Cole Deed for 320 acres lands This indenture made this ....day of..... in the year of our Lord one thousand seven hundred and eighty. Between Charles Mumford of the County of Duplin and State of No. Carolina of the one part & Robert Cole of the same County & State aforesaid of the other part witnesseth, that the said Charles Mumford for divers good causes and considerations him thereunto moving, but more especially for an din consideration of the sum of thirty pounds currency to him in hand paid or secured to be paid before the sealing & delivering hereof, the receipt whereof he doth hereby acknowledge, & himself therewith to be fully satisfied & content and thereof & therefrom doth hereby acquit, the aforesaid Robert Cole his heirs executors administrators and assigns, hath bargained sold enfeoffed & confirmed & hath by these presents for himself his heirs executors & adminis. hath & doth fully freely & absolutely bargain sell enfeoffe convey & confirm to the said Robert Cole his heirs and assigns one certain tract or parcel of land containing by estimation three hundred and twenty acres, be the same more or oess, lying & being in the County of Duplin and State of North Carolina on East side of the No. East River & north side of Limestone Swamp on both sides of Horse Branch. Begining at a cypress by the run of Limestone Swamp, by the mouth of Cabbin Branch, & runs No. 45 Wt. 256 poles to a pine near Horse Branch, thence crossing the branch South 45 Wt. 320 poles to a pine by a Tar Kiln, then So. 45 Et. 166 poles to a pine near gum branch by William Folsom's line, then up Limestone to the begining, the said land was granted to Anthony Miller by a patent bearing date the 22nd day of July 1774, & conveyed from him the said Anthony Miller to Charles Mumford & from him to Robert Cole. To have and to hold the said three hundred and twenty acres of land, William Nethercuts older patent land & a small point of the said Mumford's old patent only excepted with the appurtenances unto the said Robert Cole his heirs and assigns forever in as full and ample manner to all intents and purposes as he the said Charles Mumford did might or could have held the same before the making hereof, & the said Charles Mumford doth hereby promise & engage for himself his heirs executors & administrators that at the time of sealing & delivery hereof, that he the said Charles Mumford doth stand seized of the said land and premises of any indefeazable estate of inheritance in fee simple, & hath in himself good right full power and lawfull authortiy to grant bargain sell convey & forever confirm the said land and premises & every part and parcel thereof with their and every of their appurtenances unto the said Robert Cole his heirs and assigns & that from time to time and at all times hereafter he the said Robert Cole his heirs and assigns by power and virtue hereof may and shall enter into have hold use occupie possess and forever enjoy the said three hundred and twenty acres of land free & clear and freely & clearly acquited discharged saved kept harmless and indemnified off and from all former or other gifts grants bargins sailles enfeoffements wills intales jointures doweries executions entents and incumbrances whatsoever, moreover the said Charles Mumford doth for himself his heirs executors and administrators do promise and engage that at any time hereafter at the reasonable request of him the said Robert Cole his heirs or assigns or at him or their cost & charges in the law, make or cause to be made & duly executed any further or other deed or instrument of writing for the sure making a good and lawful title of the said three hundred and twenty acres of land and premises to him the said Robert Cole his heirs & assigns forever, as he the said Robert Cole his heirs or assigns or his or their Council learned in the law advises devises or required & furthermore the said Charles Mumford doth hereby covenant and agree for himself his heirs executors & administrators to and with the said Robert Cole his heirs and assigns to warrant and froever defend the title of the said three hundred and twenty acres to him the said Robert Cole his heirs or assigns, free from the claims of him the said Charles Mumford his heirs executors administrators or assigns or any other person or persons whatsoever, laying any lawfull claim thereunto. In witness whereof the said Charles Mumford hath hereunto set his hand & seal the day & year first above written. Charles Mumford Signed sealed & delivered in the presence of us Robin Southerland Patience Southerland State of No. Carolina Duplin County April Term 1788.
