(Transcribed by Joan S Dunn) Deed Book 1 A Page 298, 299, & 300 Charles Merrit To Benjamin Ezzell Deed for 50 acres lands This indenture made this thirteenth day of March in the tenth year of American Independence & in the year of our Lord one thousand seven hundred & eighty six. Between Charles Merritt of the State of No. Carolina & County of Duplin of the one part & Benjamin Ezzell of the same place of the other part. Witnesseth, that the said Charles Merrit for diverse good causes & consideration him thereunto moving, but more especially for the valuable consideration of the sum of twelve pounds current money of the State aforesaid to him in hand well and truly paid or secured to be paid by Benjamin Ezzell aforesaid befor the ensealing & delivery of these presents, the rect. whereof is hereby acknowledged, hath by these presents given granted bargained sold assigned & set over the said Benjamin Ezzell his heirs and assigns forever, one certain tract or parcel of land situate lying and being in Duplin County aforesaid, on the east side of Stewarts Creek, being part of his the said Merrits old survey of 150 acres whereon he now lives and part of a new survey of said Merrits of one hundred acres granted November 9th 1784. Beg. at a poplar in Merrits Branch at the mouth of the first branch below said Merrits little field being said Ezzell's corner of a deed of one hundred acres purchases from siad Merrit & Co. runing thence nearly a north course to a pine, on the line of the said new hundred acre survey which piece is marked and agreed to be the dividing corner between them the said Merrit & Ezzell thence the line of said new survey So. 75 Wt. to a pine the corner of the same and joining Thomas James's line, thence the other line of the paten So. 55 Wt. along Thomas James's line to the creek or untill it reaches the line of said deed of one hundred acres, thence the line of the said deed with the run of the branch, up to the first station, containing in the whole fifty acres be the same more or less. To have and to hold the aforesaid land & premises with all the appurtenances to the same belonging or in any wise appertaining of every nature or kind whatsoever to him the said Benjamin Ezzell his heirs and assigns forever free from all former gifts grants mortgages intails wills executions entents or troubles whatever, commited or done by him the said Merrit or any other person or persons whatever by from or under him or them or any of them, & the said Charles Merrit the aforesaid land & premises to him the said Benjamin Ezzell his heirs and assigns shall and will warrant and forever defend from and against him the said Charles Merrit his heirs & assigns as also from and against the just & lawfull claim of all and every other person or persons who may hereafter lay any lawfull claim to the same. In witness whereof the said Charles Merrit hath hereunto set his hand & seal the date above written. Charles Merrit Signed Sealed & delivered in presence of us Austin Beesley Thomas Carlton State of North Carolina Duplin County October Term 1786.
