(Transcribed by Joan S Dunn) Deed Book E Page 215, 216, & 217 Charles Merit To John Carleton Deed 335 acres This Indenture made the sixteenth Day of February in the fifteenth year of American Independence and in the year of our Lord one thousand seven Hundred and Ninety one Between Charles Merit of the State of North Carolina and County of Duplin of the one part and John Carleton of the same place of the other part. Witnesseth that the said Charles Merit for Diverse good causes and considerations him thereunto moving but mor especially for the valuable consideration of the sum of one Hundred pounds current money of the State aforesaid to him in hand well & Truly paid or secured to be paid by John Carleton aforesaid before the Ensealing and Delivery of these presents the Receipt and payment whereof is hereby acknowledged he the said Charles Merit hath by these presents granted bargained sold assigned and set over to the said John Carleton his heirs and assigns forever one certain Tract or parcel of Land situate lying and being in the County of Duplin aforesaid on the East side of Stewarts Creek joining the Lower side of Thomas James's Lands and said John Carletons Line Being part of three Patents granted to the said Charles Merit at Different times Viz. The first Patent was granted the 9th of December 1761 the other Two were granted the 10th of November 1784 and bounded as follows viz. Begining at a pine the sixth corner of said Merrits Late survey of one Hundred and fifty acres thence the Patent Line No. 85 Wt. 100 poles to a pine the corner of his one Hundred acres survey thence the line of that survey No. 5 Et. 60 poles to a pine thence the Patent line being also Thomas James's Line Wt. 124 poles to a pine thence So. 75 WT. 16 poles to a blackjack and pine Benjamin Ezzells corner thence his lines across the Three surveys So. 22 Wt. 60 poles to a pine on the hill by the branch thence across the big Branch and up a Little Drean that makes out on the South side about So. 5 WT. 40 poles to a hickory by the head of said Drain thence So. 15 Wt. 28 poles to a pine thence So. 10 Wt. 24 poles to a pine thence So. 20 poles to a pine thence SO. 7 Et. 36 poles to a pint thence So. 2 Et. 36 poles to a pine on the Paten line thence as the Paten Et. 236 poles to a pine John Carletons line thence as his Line No. 62 poles to a water oak in a Branch thence up the Branch by various courses to a Maple John Carletons corner formerly Peter Gilstraps corner thence to the Beginig containg in the whole by Survey Three Hundred and Thirty five acres be the same more or less To have and to hold the aforesaid Land and premises with all the appurtainances to the same Belonging or in any wise appurtaining to him the said John Carleton his heirs and assigns forever and the said John Carleton the aforesaid Land and premises shall and may have hold use occupy enjoy and possess os his own free and Lawfull Inheritance in Fee simple him and his Heirs forever free from all former gifts grants mortgages intails wills Executions Entents of Troubles whatever given granted or done by him the said Charles or any other person or persons whatsoever by from or under him or them or any of them and the said Charles Merit for himself his heirs Exers. administrators and assigns doth hereby warrant and forever Defend the said three Hundred and thirty five acres of Land to him the said John Carleton his Heirs and assigns forever from and against him the said Charles Merrit his heirs and assigns as also from and against the just and Lawfull claim of all and every other person or persons whatever who may hereafter lay any lawfull claim to the same. In Witness whereof the said Charles Merrit hath hereunto set his hand and seal at Duplin Date before written signed sealed and Delivered In Presence of us Charles Merrit Joseph Dickson Alexander Dickson Francis Locke State of No. Carolina Duplin County April Term 1791 Then was the within Deed proved in open Court by the oath of Joseph Dickson and ordered to be Registered.
