(Transcribed by Joan S Dunn) Deed Book 1 A Page 290, 291, & 292 Arthur Stokes To John Mallard Deed for 120 acres lands This indenture made this twenty ninth day of May and in the eleventh year of our Independency in the year of our Lord one thousand seven hundred and eighty six. Between Arthur Stokes of the State of No. Caolina & County of Duplin of the one part, and John Mallard of the State & County aforesaid of the other part. Witnesseth that the said Arthur Stokes for and in consideration of the sum of sixty pounds specie to him in hand paid by the said John Mallard before the delivery of these presents receipt whereof he doth hereby acknowledge & himself to be therewith fully satisfied contented and paid hath given granted bargained sold confirmed & conveyed and by these presents doth bargain sell confirm convey & set over unto the said John Mallard his heirs and assigns forever, all that tract or parcel of land lying and being in Duplin County aforesaid on the Hoos Branch. Begining at a black gum on a pond & runs SO. 24 Wt. 126 pole to a red oak, thence Wt. 32 pole to a pine sapling on Andrew McIntire's line, thence with the line No. 35 Wt. 20 pole to a pine, thence No. 30 Et. 26 pole to a white oak, Joseph Dickese's corner, thence with his line No. 35 Wt. 120 pole to a pine, thence to the begining, containing eighty acres of land as by paten bearing date the twenty seventh day of April one thousand seven hundred and sixty seven granted to Mathew Canady as may full appear, as also one other tract or parcel of land lying in the County aforesaid joining the aforesaid lands on both sides of Horse Branch. Beging at a red oak on the South side of the branch his own corner, thence as the same North 24 Et. 124 pole to a gum in a pond, thence So. 40 Et. 56 poles to a pine his corner of another survey, thence as the same So. 24 Wt. 127 poles to a pine thence to the beging, containing forty acres of land as patened doth appear. To have and to hold the aforesaid two tracts of land and premises with all and singular the rights mentions and appurtenances thereunto belonging or in any wise appurtaining to him the said John Mallard his heirs and assigns forever in as full and ample manner as he the said Arthur Stokes might or could enjoy the same had these conveyances never been made without the cost lett hindrences or interuption of him the said Arthur Stokes his heirs or assigns, that free and freely & clarly acquited of all and all manner of former or other gifts grants bargains sails leases wills mortgages intails jointures judgements dowers executions entents or troubles of any kind whatsoever had made or done by him the said Arthur Stokes his heirs or assigns except the quit rents that shall annually become due and the said Arthur Stokes doth hereby for himseld his heirs and assigns covenant & agree to & with the said John Mallard his heirs & assigns that he the said Arthur Stokes is the sole right full & lawfull owner of the aforesaid two tracts of land & premises and that he hath in himself full and absolute power to sell & convey the same away forever, and the said Arthur Stokes doth oblige himself his heirs executors administrators to warrent & defend the same from & against him the said Arthur Stokes his heirs or assigns and from and against all and all manner of persons whatsoever claiming by from or under or their or any of them or who lawfully claim or lawfully may clame the said hereby granted premises & he the said Arthur Stokes for himself his heirs and assigns doth hereby further covenant & agree to save and keep harmless & in demnified him the said John Mallard his heirs executors administrators & assigns & each and every of them from all and all manner of incumbrances damages which he or they or any of them may sustain in account any former or future omission or act done or to be don by the said Arthur Srokes relative to the said hereby granted premises. In witness whereof he the said Arthur Stokes hath hereunto set his hand and seal the day and year first above written. Arthur Stokes Signed Sealed & delivered in presence of us Phill Southerland Joseph Mallard State of North Carolina Duplin County July Term 1786.
