Alexander Armstrong To James Heath
Deed for 460 acres of lands
This indenture made the fourth day of August in the ninth year of American Independance,
and in the year of our Lord Christ one thousand seven hundred & eighty four between Alexander
Armstrong of the State of No. Carolina & County of Duplin of the one part, and James Heath of
the same place of the other part. Witnesseth, that the said Alexander Armstrong for divers
good causes and considerations him thereunto moving but more especially for the valuable sum
of one hundred pounds specie to him in hand well and truly paid or secured to be paid by James
Hall aforesaid before the ensealing & delivery of these presents, the receipt wherof is hereby
acknowledged, hath by these presents given granted bargained sold assigned & set over to the
said James Heath, his heirs & assigns forever, the following tracts of parcels of land, situate
lying an being in the County of Duplin aforesaid on the West side of Maxwell swamp and bounded
as follows Viz. one tract of one hundred acres patend by Isaac Parker. Begining at a Turkey
oak on the side of Frans branch runing thence So. 60 Wt. 126 pols to a black oak, thence No. 22
Wt. 126 pole to a Lightwood Stump, thence No. 88 Et. 126 pole to a pine, thence to the begining.
Also one other tract of fifty acres which was conveyed from Abraham Beesley to the said Alexr.
Armstrong the eighth day of Septr. 1776. Begining at the run of Jamey's branch on Beesley's
upper line & runs with the paten line So. 50 Et. 127 poles to the line of the other survey,
thence as the line of the said survey No. 40 Et. to a red oak the 2nd corner of the land said
Beesley bought from James Willias, thence So. 50 Et. to the run of Maxwell swamp, thence down
the run as it meanders to the mouth of Jamey's branch, thence up branch by various courses to
the line of the new patent, thence up with the new patent to the begining, also one other tract
of one hundred and ten acres granted to the said Alexr. Armstrong the first day of April 1780.
Begining at a red oak on the edge of Parker's Branch being the first station of one hundred
acres patend by Isaac Parker, thence as that line So. 68 West 126 poles to a red oak his corner,
thence So. 25 Et. 116 poles to a Black Jack on Abraham Beesley's line, thence as his line No.
40 Et. 100 poles to a pine his corner, thence his other line So. 50 Et. 127 poles to a stake,
thence No. 45 Et. 80 poles to a Red Oak, thence by Austin Beesley's line No. 25 Wt. 56 pole to
a pine, thence No. 48 pole to a White Oak at the run of Armstrong's Branch, thence up the run
untill opposite the begining, thence to the first station, also one other tract of two hundred
acres granted to the said Alexr. Armstrong the first day of April 1780. Begining at an ashe at
the run of Jamey's branch on Abraham Beesley's line & his own corner of another survey, thence
his own line No. 25 Wt. 74 poles to a red oak his corner, thence his other line No. 23 Wt. 128
poles to a red oak his corner, thence his other line No. 23 Wt. 128 pole to a pine, white oak &
black jack his corner, thence his other line No. 67 Et. 66 poles to a poplar in Armstrong's
Branch, thence up the branch as it meanders with James Williams' line 210 poles to a maple and
gum, thence So. 200 poles to a pine, thence So. 80 Et. 80 poles to a water oak in Jamey's Branch,
thence down the branch with Abraham Beesley's line to the begining, containing in the said four
pieces of land by estimation four hundred & sixty acres be the same more or less. To have and
to hold the aforesaid land & premises, with all the appertenances to the same belonging or in
any wise appertaining to him the said James Heath his heirs & assigns forever, free from all
former gifts grants mortgages intails wills dowers executions entents & troubles whatsoever
suffered committed or done by him the said Alexr. Armstrong or any other person by from or under
him, and the said James Heath the aforesaid land & premises shall and may have hold use occupy
enjoy & possess as his own fee & lawful inheritance free from all incubrances wharwoever suffered
commited or done by him the said Alesr. Armstrong or any other person by from or under him and
the said Alexr. Armstrong himself his heirs Execr. Admin. and assigns the aforesaid land and
premises to him the said James Heath his heirs & assigns shall & will warrant & forever defend
by these presents from & against him the said Alexr. Armstrong his heirs & assigns as also from
& against the just & lawful claim of all and every other person or persons whatever who may
hereafter lay any lawful clame to the same. In witness whereof the said Alexr. Armstrong hath
hereunto set his hand & seal the date above written.
