Deed of Gift 200 acres
State of North Carolina Duplin County
This Indenture made this second day of January A. D. one thousand eight Hundred and
thirty nine between Alexander Heath of the one part and John Henry Heath of the
other part boath of the County and State aforesaid Witnesseth that the said Alexander
Heath for and in consideration of the natural live and affection he doth bear unto his son
said John Henry Heath and diverse other causes him moveing thereunto and the fother
consideration of the sum of one dollar to him in hand paid by the said John Henry Heath
before the signing sealing and delivery of these presents hath bargained given and forever
set over to the said Henry Heath a certain tract or parcel of Land in the County aforesaid
and bounded as follows. Beginning at a small Black Gum in the East Edge of Maxwell
Swamp and runs thence North Sixty east thirty four poles to an ash on the run of said
swamp and at the mouth of Folly Branch then up the run of said Branch a corner nearly
North Forty East fifty poles to a water oak at the mouth of a small drain then up the eastern
Edge of said Folly Branch so as include the Grist Mill and continue up with high water mark
on the east side to a poplar in said Branch Stricklines corner thence North Seventy four
West 68 poles to a pine at the side of the great Road thence North 19 west 43 poles to a
pine John Heaths corner then South 70 west 186 poles to a stake in the Run of Maxwells
Swamp John Heaths corner thence down the various courses of the run as it meanders to
the Bush line then with it and the land owned by James Heath to Two Hickories thence to
the corner W. Swinsons 12 acres then as his line about East 18 poles on the west edge
of Maxwell Swamp then down the Swamp to the beginning containing Two hundred acres
be the same more or Less and the said Alex. Heath doth hereby convey confirm and forever
set over to the said Henry Heath the aforesaid land and premises with the exception of the
part of said land conveyed by MacGees Mill pond and one acre at the end of the dam and
the said Alexander Heath doth hereby warrant and forever defend the said land grist mill &
dwelling House only Reserving his own lifetime on said land building & grist mill to the said
John Henry Heath and his heirs forever against the lawfull claim or claims of all and every
person or persons whatsoever with the exception above mentioned by these presents. In
witness whereof the said Alexr. Heath hath hereunto set his hand and affixed his seal the
day & date above written.
