Abraham Newkirk To William Southerland
Deed for 280 acres lands
This indenture made 14d in the year of our Lord one thousand seven hundred and
eighty five. Between Abraham Newkirk of the said County & State of No. Carolina of the
one part & William Southerland of the of the same County & State aforesaid of the other
part. Witnesseth that the said Abraham Newkirk for divers good causes & considerations
him thereunto moving, but more especially for and in consideration of the sum of five
hundred pounds specie to him inhand secured to be paid in hand or secured to be paid
before the sealing & delivering thereof, the receipt he doth hereby acknowledge himsel
to be therewith fully satisfied & content & thereof & therefrom doth hereby acquit the
aforesaid William Southerland his heirs executors administrators or assigns, hath
bargained sold enfeoff conveyd confirmed & doth by these presents for himself his heirs
executors & administrators hath & doth fully freely & absolutely bargain sell enfeoffe
& convey and forever confirm unto the said William Southerland his heirs and assigns,
one certain tract or parcel of land containing by estimation two hundred & eighty acres
lying in the County aforesaid & entered by Abraham Newkirk warrant No. 1191 on the No.
side of Limestone Swamp, above the mouth of Gum branch. Begining at a urch on Folsom's
line, & runs with his line No. 45 Wt. 160 pole crossing gum to a pine,thence No. 45 Et.
280 poles crossing gum to a Lightwood stump, thence So. 45 Et. 160 pole to a gum in
Limestone Swamp, thence down said swamp to the begining William Fulsom's old patent
land excepted, it being a tract of land granted to Abraham Newkirk, bearing date 1784,
& in the ninth year of American Independence. To have & to hold the said 280 acres of
land and premises, with the appurtenances thereto belonging to the said William Southerland
his heirs & assigns forever, in as full and ample manner to all intents & purposes as
he the said Abraham Newkirk did might or could have held the same before the making
hereof, & the said Abraham Newkirk doth hereby promise himself his heirs executors &
administrators at the time of sealing & delivering is & stands seized the said lands &
premises of an indefeasable state of inheritance in fee simple, & hath in himself good
right, full power and lawfull authority to grant bargain sell convey & forever confirm
the said lands and premises & every part & parcel thereof with their & every of their
appurtenances unto the said William Southerland his heirs & assigns forever, and that
from time to time & at all times forever hereafter, he the said William Southerland his
heirs & assigns by power and virtue hereof,k may and shall enter into have hold use
occupie possess & forever enjoy the said 280 acres of land free & clear freely & clearly
acquitted discharged saved held harmless & indemnified of and from all former or other
gifts grants bargains sales enfeoffments wills intales jointures dowers executions entents
& incumbrances, moreover the said Abraham Newkirk doth for himself his heirs executors
administrators do promise & engage that at any time hereafter at reasonable request of
him the said William Southerland his heirs or assigns or at his or their cost & charges
in the law make or cause to be made & duly executed any further or other deeds or
instruments of writing for the sure making a good lawfull title of the said lands &
premises to him the said William Southerland his heirs & assigns forever, as the said
William Southerland his heirs & assigns or his or their council learned int he law shall
advise devise or require and moreover the said Abraham Newkirk doth covenant and agree
for himself his heirs executors administrators to & with the said William Southerland
his heirs & assigns to warrant & defend forever the title of the said 280 acres of land
to him the said William Southerland his heirs and assigns, free from the lawfull claim
of him the said Abraham Newkirk his heirs executors administrators or any other person
or persons whatsoever. In witness whereof the said Abm. Newkirk hath hereunto set his
hand & seal the day & year above written.
