Abraham Newkirk To Henry Newkirk
Deed for 100 acres lands
This indenture made this eighteenth day of July one thousand seven hundred and eighty
six. Between Abraham Newkirk of the County of Duplin and State of No. Carolina of the one part,
and Henry Newkirk of the same County and State aforesaid of the other part. Witnesseth, that
the said Abraham Newkirk for divers good causes and consideration him thereunto moving but more
especially for and in consideration of the sum of one hundred pounds specie to him in hand paid
or secured to be paid before the sealing & delivery of these presents, the receipt whereof he
doth hereby acknowledge and himself therewith to be fully satisfied & content and thereof and
therefrom doth hereby acquit the aforesaid Henry Newkirk his heirs executors administrators &
assigns hath bargained sold enfeoffed conveyed and confirmed & hath by these presents for
himself his heirs executors administrators hath and doth fully paecly and absolutely bargain
sell enfeoffe convey and forever confirm unto the said Henry Newkirk his heirs and assigns one
certain tract or parcel of land containing by estimation one hundred acres lying and being in
the County of Duplin on the south side of Limestone Swamp joining Felix Kenan's & James Paterson's
and his own. Begining at a pine on his own line and runs South sixty poles to a pine Patterson's
corner, thence with his other line No. 86 Et. 203 pole to a pine, thence No. 66 poles to a pine
on Kenan's line, thence with his line tot he begining, which said one hundred acres of land was
granted to Abraham Newkirk by a patent bearing date the tenth day of November in the year of
our Lord one thousand seven hundred and eighty four, and conveyed from him the said Abraham
Newkirk to Henry Newkirk. To have and to hold the said one hundred acres of land and premises
with the appurtenances unto the said Henry Newkirk his heirs and assigns forever, in as full and
ample manner to all intents & purposes as he the said Abraham Newkirk did might or could have
held the same before the making hereof and the said Abraham Newkirk doth hereby promise and
engage for himself his heirs executors & administrators that at the time of sealing & delivery
hereof, that he the said Abraham Newkirk is and stands seized of the said land and premises of
an indefeazible estate of inheritance in fee simple, and hath in himself good and rightfull
power and lawfull authority to grant bargain sell convey and forever confirm the said land and
premises & every part and parcel thereof with their and every of their appurtenances unto the
said Henry Newkirk his heirs and assigns and that from time to time and at all times forever
hereafter he the said Henry Newkirk his heirs and assigns by power and virtue hereof may & shall
enter into have hold use occupie possess and forever enjoy the said one hundred acres of land
free and clear & freely & clearly acquited discharged kept harmless & indemnified off & from all
former or other gifts grants bargains sales enfeoffments jointures dowries executions entents &
incumbrances whatsoever moreover the said Abraham Newkirk doth for himself his heirs executors
and administrators do promise and engage that at any time hereafter at the reason able request
of him the said Henry Newkirk his heirs and assigns, or at his or their cost and charges in the
law, make or cause to be made and duly executed any further or other deed or instrument of
writing for the sure making a good and lawfull title of the said one hundred acres of land and
premises to him the said Henry Newkirk his heirs and assigns forever, as he the said Henry
Newkirk his heirs or assigns or his or their councils learned in the law shall advise devise or
require, and furthermore the said Abraham Newkirk doth hereby covenant and agree for himself his
heirs executors & administrators to and with the said Henry Newkirk his heirs and assigns to
warrent and forever defend the title or the said one hundred acres of land to him the said Henry
Newkirk his heirs or assigns free from the claim of him the said Abraham Newkirk his heirs
executors administrators or assigns or any other person or persons whatsoever claiming any
lawfull claim thereunto. In witness whereof the said Abraham Newkirk hath hereunto set his
hand and seal the day and year first above written.
