Abner Quin To William Nethercut
Deed for 100 acres lands
This indenture made this fourth day of September in the year of our Lord one thousand seven
hundred and eighty three between Abner Quin of the County of Cartright and State of No. Carolina
of the one part and William Nethercut of the County of Duplin and State aforesaid of the other
part. Witnesseth that the said Abner Quin for divers good causes & considerations him thereunto
moving, but more especially for and in consideration of the sum of thirty pounds specie to him
in hand paid & secured to be paid before the sealing and delivery hereof, the receipt whereof
he doth hereby acknowledge & himself therewith to be fully satisfied and contented thereof &
therefrom doth hereby acquit the aforesaid William Nethercut, his heirs executors administrators
and assigns, hath bargained sold enfeoffed & confirmed and hath by these presents for himself
his heirs executors and administrators, hath & doth fully freely and absolutely bargain sell
enfeoffe convey & forever confirm unto the said William Nethercut, his heirs, and assigns, one
certain tract or piece of land containing by estimation one hundred acres of land be the same
more or less, lying & being in the County of Duplin & State aforesaid, on the north side of
Limestone swamp and on both side of Cabbin branch including his improvements. Begining at a
post on the east side of said branch, Charles Mumford's corner, and runs as his line So. 50 Et.
54 poles to maple and water oak, thence No. 67 Et. 54 poles to a pine by Anthony's corner,
thence No. 20 Wt. 122 po. to a pine, thence So. 70 Wt. 133 poles to a pine, thence So. 70 Et.
90 pole to a stake one Anthony Miller's line, thence as his line So. 45 Et. 46 pole to a maple
at the run of Cabbin Branch, thence with the run to the begining, which said one hundred acres
of land was granted to Abner Quin by a pattent bearing date July the first one thousand seven
hundred and seventy nine & conveyed from him the said Abner Quin to William Nethercut. To have
and to hold the said one hundred acres of land and premises with the appertenances unto the said
William Nethercut his heirs and assigns forever in as full and ample manner to all intents and
purposes as he the said Abner Quin did might or could have hold the same before the making
hereof, and the said Abner Quin doth hereby promise and engage for himself his heirs executors
& administrators that at the time of sealing and delivery hereof that he the said Abner Quin is
and stand seized of the said land and premises of an indefeazable estate of inheritance in fee
simple and hath in himself good and rightful power & lawfull authority to grant bargian sell
convey & forever confirm the said land and premises and every part and parcel thereof with
their and every of their appertenances unto the said William Nethercur his heirs and assigns
and that from time to time and at all times forever hereafter, to the said Wm. Nethercut his
heirs and assigns by power and virtue hereof may and ahall enter into have hold use occupy
possess and forever enjoy the said one hundred acres of land free and clear and freely and
clearly acquited discharged saved kept harmless and indemnified off & from all former and other
gifts grants bargains sales inforsements wills intails jointures dowers executions extents and
incumbrances whatsoever, more over the said Abner Quin doth for himself his heirs executors and
administrators do promise and engage that at any time hereafter at the reasonable request of
him the said William Nethercut his heirs or assigns, at at his or cost and charges in the law
make or cause to be made and duly executed any further or other deed or instrument of writing
for the time making a good and lawful title of the said one hundred acres of land & premises to
him the said William Nethercut his heirs and assigns forever, he the said William Nethercut his
heirs or assigns or his or their councils learned in the law shall advise devise or require,
and further more the said Abner Quin doth hereby covenant and agree for himself his heirs
executors and administrators, to and with the said William Nethercut his heirs and assigns to
warrant and for ever defend the title of the said one hundred acres of land to him the said
William Nethercut his heirs and assigns free from the claim of him the said Abner Quin his
heirs executors administrators of assign or any other person or persons whatsoever laying any
lawfull claim thereunto. In witness the said Abner Quin hath hereunto set his hand & seal the
day and year first above written.
