  Confederate Soldier, Teacher and Minister Born - 23 December 1835, Magnolia, Duplin co. North Carolina Died - 13 November 1905, Warsaw, Duplin co. North Carolina Buried - Old Towne Cemetery, Warsaw, Duplin co North Carolina Will of Luther Rice Carroll of Sampson County and State of North Carolina, Being of sound and disposing mind and memory but recognizing the Uncertainty of life and the certainty of death, do publish and declare this to be My last will and testament. Item 1st. I direct my executrix, hereinafter named to pay all my just debts, if any, and burial expenses out of any money on hand or the first that may come into her hands. Item 2nd. I give and bequeath to my beloved wife Jemima Ann Carroll all my personal property of every kind and description to have and to hold the same for her own use, purpose, benefit and behoof forever. Item 3rd . I give and bequeath to my beloved wife Jemima Ann Carroll, all my real estate, including all money on hand or deposit also all notes and accounts due me, to have and to hold the same for her own use, purpose, benefit and behoof forever. Item 4th I herby constitute my beloved wife Jemima Ann Carroll, Executrix of this my last will and testament. In witness, whereof I have signed and sealed and published and declared this instrument as my last will, on the 18th day of Feby. 1885. L.R. Carroll (seal) The said L. R. Carroll did on the 20th day of June 1890 acknowledge, publish and declare the foregoing instrument as and for his last will and we at his request and in is presence and in the presence of each other have hereunto written out names as subscribing witnesses.
