William Magee To John Magee
Deed for 400 acres lands
State of North Carolina to all to whom these presents shall come I William Magee of the County
and State aforesaid send greeting. Know ye that I the said William Magee for and in consideration
of the sum of seventy five pounds specie to me in hand paid at and before the ensealing and
delivery of these presents, by John Magee the receipt whereof I do hereby acknowledge and myself
to be therewith fully contented satisfied & paid have given granted bargained sold aliened
enfeoffed conveyed affirmed assigned and set over unto the said John Magee all his rights of
land whareon he formerly lived in Duplin County on the Marsh branch joining Muddy Creek, one
plantation on the South side of Marsh Branch, one plantation on the north side of same branch
where John Magee's store is & one plantation in the fork of the same branch, it being the tracts
of land that William Magee bought of John Woodward four hundred acres, be the same more or less.
Begining at a black gum in the creek below the Marsh branch, thence up the creek a north cause
to a maple John Woodward's line, thence up the swamp a north course 180 poles to a small white
oak Jacob Brown's lower corner, thence along the line No. 75 Wt. 127 pole to a pine his corner,
thence So. 20 Wt. 140 pole to a white oak, thence No. 80 Wt. 120 poles, thence So. 10 Wt. 200
pole to a pine & two white oaks by a branch, thence down the branch No. 75 Et. 100 poles to a
pine Richard Keens corner the south side of the branch, thence down the branch the south side
to Ebenezer Garrison's lower line, thence Wt along his line to Keen's old line, thence along
his line to the begining. To have and to hold the aforesaid plantation or tracts of land lying
and being as aforesaid in Duplin County, four hundred acres of land, be the same more or less,
together with all the improvements, houses out houses orchards fields, and water courses woods
& trees, all other appertenances to the same belonging or in any wise appertaining unto the said
John Magee his heirs and assigns forever, to his & their own proper benefit & behoofs, and I the
said William Magee for myself my heirs executors and administrators, do covenant grant promise
and agree to & with the said John Magee in manner and form following, that is to say, that he
the said John Magee his heirs and assigns shall and may from time to time & at all times hereafter
peacebly and quietly have hold and occupy possess & enjoy the pre bargained premises & appertenances
and every part and parcel thereof, free and clear of and from all and all manner of charges and
incumbrances whatsoever had made done or committed by me the said William Magee or any person
by my or desments or provements, and I the said William Magee & my heirs executors administrators
the said bargained premises & appertenances & every part and parcel thereof, unto the said John
Magee his heirs executors administrators and assigns against all and all manner of persons
whomsoever shall and will forever defend by these presents. In witness hereof I the said William
Magee have hereunto set my hand & seal this 23rd day of November one thousand seven hundred and
eighty four, and in the eighth year of Independence.
