Thomas & Robert Miller To James Rogers
This Indenture made this Eight day of November in the year of our Lord Christ one
thousand seven Hundred and Eighty five and in the tenth year of American Independence.
Between Thomas Miller and Robert Miller of the State of North Carolina and County of Duplin
of the one part and James Rogers of the same place of the other part. Witnesseth that for
and In consideration of the sum of sixty nine pounds currency to him in hand well and Truly
paid before the Ensealing and Delivery of these presents to the Receipt whereof is Hereby
acknowledged hath by these presents given granted Bargained sold assigned and set over to
the said James Rogers his Heirs and assigns forever the following Tract or parcel of Land
situate lying and being in the COunty aforesaid on the west side of Maxwell swamp on Carrs
Branch. Begining at a white oak William Rigliss corner thence No. 50 Wt. up the branch
127 poles to a Red oak thence No. 40 Et. 127 poles to a Lightwood tree thence So. 50 Et.
127 poles to a stake in a pond thence to the Begining being the contents of a Patent granted
to Solomon Beesley for one Hundred acres bearing date the 25th of July 1774 also one other
tract or parcel of Land in the County aforesaid on the west side of Maxfield swamp and both
sides of Carrs branch joining the above mentioned one Hundred acre survey Begining at a
white oak by a Lightwood tree the third corner of said other survey Joshua Hudgenses corner
thence as his line Wt. 180 poles to a pine his corner thence So. 200 poles to a pine thence
So. 65 Et. 250 poles to a white oak in a glade Rigbies corner thence along the line of
Solomon Beeslys old one Hundred acres survey No. 50 Wt. 127 poles to a Red oak thence the
other line No. 40 Et. 127 poles to the first station containing in the whole Two Hundred
and fifty acres be the same more or less. To have and to hold the aforesaid Lands and
premises with all the appurtainances to the same belonging to him the said James Rogers
his heirs and assigns forever free from all former gifts grants mortgages Deeds wills
Executions Entents of Troubles whatsoever committed or done by them the said THomas Miller
and RObert Miller or any person by from or under them and the said Thomas Miller and Robert
Miller the aforesaid Lands and premises tohim the said James Rogers shall and will warrant
and forever Defend to him and his Heirs from and against him the said Thomas Miller and
Robert Miller their Heirs and assigns as also from and against the just and Lawfull claim
of all persons whatsoever who may here after lay any lawfull claim to the same In Witness
whereof the said Thomas Miller and Robert Miller hath hereunto set their hands and fixed
their seals the Day and date above written
