James Wright To Jacob Wells
Deed for 440 acres lands
This indenture made this eighth day of September in the year of our Lord one
thousand seven hundred & eighty seven & in the twelvth year of Independency, Between
James Wright of the County of New Hanover and State of No. Carolina of the one part
and Jacob Wells junr. of the same State & County of Duplin of the other part.
Witnesseth that the said James Wright for divers good causes & considerations but
more especially for and in consideration of the sum of two hudred pounds to him in
hand paide or secured to be paid before the sealing and delivering hereof, the receipt
whereof he doth hereby ackinowledge & himself therewith to be fully satisfied &
contented & thereof & therefrom doth hereby acquit the aforesaid Jacob Wells his heirs
executors administrators & assigns hath doth bargained sold enfeoffed conveyed and
confirmed & hath by these presents for himself his heirs executors and administrators
hath & doth fully freely & absolutely bargain sell enfeoffe convey and forever confirm
unto the said Jacob Wells his heirs and assigns one certain tract or parcel of land
containing by estimation four hundred and forty acres lying and being in the County of
Duplin on the No. side of Rockfish Creeki, a place calle Potter's land. Begining at a
large pine in the South edge of a small Island a fore & aft tree thence along Hawkins's
or Duffs line North twelve east one hundred and sixty four poles to a white oak &
persimmon four poles north of Hawkin's corner, thence James Phebus' lline south sixty
five east two hundred & eighty poles to a pine, north edge road, thence south fifty west
one hundred & thirty poles to a pine, thence Shadrack Stallings' line South thirty east
one hundred & eighty poles to a pine, thence South sixty west eighty two poles to a pine,
thence west one hundred and six poles to a water oak on the creek bank thence up the
creek as it meanders until north twelve east strikes the begining, thence to the first
station. To have and to hold the said four hundred and forty acres of land & premises
with the appurtenances unto the said Jacob Wells his heirs and assigns forever, in as
full and ample manner to all intents & purposes as he the said James Wright might or did
or could have held the same before the making hereof, & the said James Wright doth hereby
promise & engage for himself his heirs executors & administrators that at the time of
sealing & delivering hereof, that he the said James Wrighty is & stands seized of the said
land and premises of an indefeazable estate of inheritance in fee simple, & hath in himself
good right full power and lawfull authority to grant bargain sell convey & forever confirm
the said land & premises and every part & parcel thereof, with their & every of their
appurtenances unto the said Jacob Wells his heirs and assigns, & that from time to time &
at all times forever hereafter, he the said Jacob Wells his heirs and assigns by power and
virtue hereof may & shall enter unto hiave hold use possess and forever enjoy the said four
hundred and forty acres oa land free and clear and freely & clearly acquited discharged
saved kept harmless indemnified of & from all former or other gifts grants bargains sales
infeofments wills intails jointures dowers executions intents & incumbrances whatsoever the
taxes which shall hereafter become annually due only excepted, moreever the said James Wright
doth for himself his heirs executors and administrators do promise and engage that at any
time at the reasonable request of him the said Jacob Wells his heirs or assigns, or at his
or their cost & charges in the law make or cause to be made & duly executed any further or
other deed or instrument of writing for the sure making a title of the said land and premises
to him the said Jacob Wells his heirs & assigns forever, he the said Jacob Wells his heirs
or assigns or his or their councils learned in the law shall advise devise or require, &
furthermore the said James Wright doth hereby covenant & agree for himself his heirs executors
& administrators to and with the said Jacob Wells his heirs and assigns, to warrant and
forever defend the title of the said four hundred and forty acres of land to him the said
Jacob Wells his heirs and assigns free from the lawfull claim of him the said James Wright
his heirs executors or administrators, or any other person or persons whatsoever. In witness
whereof the said James Wright hath hereunto set his hand & seal the day & year first above
written.
