James Morris To Daniel Hicks
Deed for 300 acres lands
This indenture made the 16th day of October in the year of our Lord one thousand seven
hundred and eighty four, between James Morris of the one part and Daniel Hicks of the other part.
Witnesseth that for and in consideration of the sum of seventy pounds to the said James Morris
in hand paid by the said Daniel Hicks at or before sealing or delivery of these presents, the
receipt whereof he doth hereby acknowledge and therefore doth release acquit and discharge the
said Daniel Hicks executors and administrators by these presents he the said James Morris granted
bargained sold alind and confirmed and by these presents doth grant bargain sell alien and
confirm unto the said Daniel Hicks and his heirs a certain piece or parcel of land sittuate
lying and being in the County of Duplin and State of North Carolina, bounded as followeth,
lying and situated on the east side of the six runs and west side of Stewarts Creek on the
head of the Marsh Branch that runs into Williams'es Mill branch about half a mile above the
mill. Begining at a black jack & runs So. 70 Et. 220 pole to a hickory thence No. 20 Wt. 220
pole to a black jack by the main road, thence No. 70 Et. 220 poles to a pine, thence to the
begining, containing three hundred acres of land and all houses buildings orchards ways waters
& water courses prophits comodities hereditaments and appertenances whatsoever to the said land
and premises hereby granted or any part thereof belonging or in any wise appertaining & the
reversion & reversions remainder & remainders rents issues and profits thereof and also all the
estate right title interest use trust property claim and demand whatsoever of him the said James
Morris off in & to the said premises and all deeds evidances and writings touching or in any
wise concerning the same. To have and to hold the lands hereby conveyed and all and singular
other the premises hereby bargained and sold and every part thereof, with their and every of
there appertenances unto the said Daniel Hicks heirs and assigns forever, to the only proper
use and behoof of him the said Daniel Hicks and of his heirs and assigns forever, and the said
James Morris for himself his heirs executors and administrators do covenant promise and grant
to and with the said Daniel Hicks heirs and assigns by these presents, that the said James
Morris now at the time of sealing and delivering these presents is siezed of a good and perfect
and indefeasable estate of inheritance in fee simple of and in the premises hereby bargained
and sold, and that he has good power and careful & absolute authority to grant & convey the
same to the said Daniel Hicks in manner & form aforesaid, and that the said premises manner
and so forever here after shall remain and be free and clear of and from all former gifts
grants bargains sales dower right & title of dower judgements executions titles troubles charges
& incumbrances whatso ever mad done committed or suffered to be done by the said James Morris
heirs & successors or any other person or persons wharsoever and that the said James Morris and
his heirs all and singular the premises hereby bargained and sold the the appertenances unto
the said Daniel Hicks heirs & assigns against him the said James Morris and his heirs and all
& every person or persons whatsoever, shall warrant & forever defend by these presents. In
witness whereof the said James Morris hath hereunto set his hand & seal the day and year first
written.
