James Middleton To David Middleton
Deed for 220 acres lands
This indenture made the twenty first day of April in the 12th year of American
Independence, & in the year of our Lord Christ one thousand seven hundred & eighty eight.
Between James Middleton senr. of the State of No. Carolina & County of Duplin of the one
part and David Middleton (son of the said James Middleton) of the other part, witnesseth,
that the said James Middleton for the affection and good will which he doth have and bear
to his son David & for divers good causes & considerations him thereunto moving, as well
for and in consideration of the sum of five pounds current money of the State aforesaid
to him in hand well and truly paid or secured to be paid by the said David befor the
ensealing & delivery of these presents, the receipt whereof is hereby acknowledged, hath
by these present given granted bargained sold assigned & set over to the said David Middleton
his heirs executors administrators and assigns, one certain tract or parcel of land situate
lying and being in the County of Duplin aforesaid on the south side of the grove swamp.
Begining at a maple at the mouth of the Indian Spring on the run of the grove swamp, George
Gibbons's corner, thence Gibbons's line crossing the Wildcat pond S0. 5 Et. 76 pole to a red
oak his corner, thence his and James Middleton's line No. 72 Wt. 34 poles to a pine said to
be Gibbons's corner, thence his & Middleton's line SO. 17 Wt. 86 poles to Lightwood stump
William Williams's corner, thence Williams's line and Jas. Middleton's line of his thirty
acre survey, runing said patent lines 141 poles to a black jack said Middleton's & Williams's
corner, thence Middleton's No. 10 Et. 42 poles to a white oak sapling & pine his corner,
thence a new line No. 10 Et. 180 poles to a maple on the run of the Grove Swamp, thence down
said run as it meanders to the first station, containing in the whole two hundred & twenty
acres by survey, be the same more or less being a full proportionate part of my land of which
I am at present possessed of in Duplin County agreeable to such share as I propose for the
rest of my family &c. To have & to hold the said bargained land and premises with all the
appurtenances to the same belonging or in any wise appertaining to him the said David Middleton
his heirs & assigns forever, free from all former gifts grants bargains wills jointures dowers
fight or title of dower or any other incumbrance whatever given granted or done by him the
said James Middleton, & the said David Middleton the aforesaid land and premises shall and
may have hold use occupie enjoy & possess as his own free and lawful inheritance in fee simple
& the said James Middleton the aforesaid land & premises shall and will warrant & forever
defend to him the said David Middleton his heirs & assigns, from and against, him the said
James Middleton his heirs and assigns, as also from & against the just & lawfull claim of all
and every other person or persons whatever who may lay any lawfull claim to the same, in as
full and ample a manner as he the said James Middleton by his deed & paten is enabled to do
(& no further). In witness whereof the said James Middleton hath hereunto set his hand and
seal at Duplin the day & year first above written.
