James Maxwell To James McIntire
Deed for 300 acres lands
State of North Carolian Duplin County. This indenture made this thirty first day of December
in the year of our Lord one thousand seven hundred and eighty four, between James Maxwell of
the County of Duplin in the province of No. Carolina of the one part and James McIntire of
the County & province aforesaid of the other part. Witnesseth that he the said James Maxwell
for and in consideration of the sum of ninety five pounds specie to him in hand paid before
the sealing and delivery of these presents by the said James McIntire the receipt, whereof
the said James Maxwell doth hereby acknowledge himself fully contented satisfied and paid and
by these presents have given granted bargained and sold unto James McIntire of the County &
province aforesaid his heirs and assigns forever, a tract or percell of land containing three
hundred acres, lying and being in Duplin County on the West side of the No. East Branch of
Cape Fear River, on Horse Branch, being the contents of a patent granted to Joseph Duke.
Begining at a small pine and runs South 35 Et. 30 chains to a white oak, thence So. 55 Wt. 33
chains & 34 links to a small pine, thence No. 35 Wt. 30 chains to a stake, thence No. 55 Et. 33
chains & 34 links to the begining, containing in the whole one hundred acres be the same more
or less, also the contents of a patent bearing date the first day of April 1780. Begining at
a white oak George Mallard's corner, thence with his line to his corner and past 100 pole to a
pine, South side of the road, No. 70 Wt. 134 pole to a pine, thence crossing the road No. 20
Et. 120 pole to a black jack, thence to the begining, also the contents of another patent
bearing date the first day of April 1780, thenc runing across the road No. 20 Et. 120 pole to
a black jack, thence No. 70 Wt. 32 pole to a pine, Arthur Stokes corner, thence as his line No.
35 Wt. 127 poles to a pine & black jack on Dukes's line, thence as Dukes's line So. 53 Wt. 102
pole to a pine his corner, thence as his line No. 37 Wt. 80 pole to a pine, thence So. 53 Wt.
78 to a pine by the road on James Gillespie's line, thence to the begining, containing two
hundred acres be the same more or less, the said bargained premises to have and to hold the
said land with all and sinqular the improvements houses orchards woods & underwoods with all
the other previleges & other liberties to the same belonging unto the said James McIntire his
heirs and assigns forever, as a good perfect and absolute setate of inheritance in fee simple,
and have in myself good right and full power and lawfull authority to bargain & sell the above
premises in manner above mentioned unto him the said James McIntire his heirs and assigns
forever, and I the said James Maxwell the aforesaid lands with all the previliges to the same
belonging unto the said James McIntire his heirs executors administrators or assigns forever,
against the proper clame of any person or persons whatsoever will warrent & secure and forever
defend free & clear of all incumbrance whatsoever, only the quit rents hereafter becoming due
according to the true intent and meaning of these presents. In witness whereof I the said James
Maxwell have hereunto set my hand affixed my seal this thirty first day of December 1784.
