(Transcribed by Joan S Dunn) Deed Book 130, & 131 Charles Merrit To Benjamin Ezzell Deed for 100 acres lands This indenture made the twenty second day of December, in the year or our Lord Christ one thousand seven hundred and eighty four, between Charles Merrit of the State of No. Carolina and County of Duplin of the one part, & Benjamin Ezzell of the same place of the other part Witnesseth that the said Charles Merrit for divers good causes and eonsiderations him thereunto moving, but more especialy for the valluable consideration of the sum of twenty pounds current money of the State aforesaid to him in hand well & truly paid or secured to be paid by Benjamin Ezzell aforesaid before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged, hath by these presents given granted bargained sold assigned & set oever to the said Benjamin Ezzell aforesaid to his heirs & assigns forever, one certain tract of parcel of land sittuate lying and being in Duplin County aforesaid on the east side of Stewarts Creek, beign part of three surveys. Begining at a pine the 3rd corner of his 150 acre survey, thence along that line No. 7 Et. to a red oak and Hickory said to be Henry Hollingsworth's corner, thence his line of a new survey No. 75 Wt. 36 poles to a black jack his corner, thence up Stewarts Creek through the cove No. 20 Et. 80 poles to an ashe at the Creek, thence his other line No. 55 Et. to the run of the Big branch, thence up said run as it meanders to the mouth of a small branch or drain, thence up said branch or drain by Merrits fence to the head to a Hickory a fore & aft tree, thence due So. crossing the old land and part of anouther new survey, thence the new survey to a stake by a Blue pond on the So. line of said survey, thence the new survey line Wt. to a pine & black jack the corner by the Juniper pond, thence his other line No. 56 poles to a pine on the old line, and with the old line to the first station, containing by estimation in the whole, one hundred acres be the same more or less. To have and to hold the aforesaid land and premises with all the appertenances to the same belonging on in any wise appertaining of every nature or kind whatwoever, to him the said Benjamin Ezzell his heirs and assigns forever, free from all former gifts grants mortgages intails dowers wills executions extents or troubles whatever, and the said Charles Merrit the aforesaid premises to him the said Benjamin Ezzell his heirs & assigns shall and will warrant and forever defend from & against him the said Charles Merrit his heirs & assigns, as also from & against the just and lawfull claim of all and every person or persons whatever, who may hereafter lay any lawful claim to the same. In witness whereof the said Charles Merrit hath hereunto set his hand & seal the date above written. Charles Merrit Signed sealed & delivered in the presence of us Arthur Matthews Will Knight State of No. Carolina, Duplin County, January Court 1785.
