Abraham Newkirk To William Farrior
Deed 100 acres
This Indenture made this twenty sixth day of february in the year of our Lord one thousand
seven hundred and ninety one. Between Abraham Newkirk of the County of Duplin and State of north
Carolina of the one part and William Farrior of the same County and state aforesaid of the other
part. Witnesseth that the said Abraham Newkirk for diverse good causes and considerations him
thereunto moving but more especially for and in consideration of the valuable sum of fifty pounds
current money of the state and County aforesiad to him in hand paid or secured to be paid to be paid
before the sealing and Delivering hereof the receipt whereof he doth hereby acknowledge and himself
therewith to be fully satisfied and content and thereof and therefrom doth hereby acquit the aforesaid
William Farrior his heirs Executors and administrators and assigns hath bargained sold enfeofed
conveyed and confirmed and Doth by these presents for himself his heirs Executors and administrators
hath and doth fully freely and absolutely bargained sell enfeoffe convey and forever confirm unto
the said William Farrior his heirs and assigns one certain Trct or parcel of Land containing one
hundred acres by Estimation be the same more or less situate lying and being in the above said
province and County of the East side of the north East and on the So. side Limestone swamp Begining
at a pine James Gillespies corner and Runs No. 65 Et. 176 pole to a stake in a meadow on or near
Barnet Brocks line thence So. 27 Et. 176 pole to a pine on said Newkirds line thence with his line
SO. 65 Wt. 250 pole to the centree of three small gums thence to the Begining for compliment it being
a survey of land granted to the said Newkirk by Patent bearing date December the 7th 1784. To have
and to hold the said 100 acres of Land and premises with the appurtainances unto the said William
Farrior his heirs and assigns forever in as full and ample manner to all tents and purposes as the
said Abram Newkirk did might or could have hold the before making hereof and the said Abraham Newkirk
doth hereby promise for himself his heirs Executors and administrators that at the time of sealing
and Delivering hereof is and stands seized of the said Land and premises of and indefeaseable estate
in fee simple and hat good and Rightfull power and Lawfull authority to grant bargain sell convey
and confirm the said Land and premises and every part and parcel thereof with their and every of
their appurtainances to the said William Farrior his heirs and assigns and that from time to time
and at all times forever hereafter he the said William Farrior his heirs and assigns by power and
virtue hereof may and shall inherit to have hold use possess and forever enjoy the said 100 acres
of Land free and clear and freely and clearly acquit dischared stand kept harmless and indemnified
of and from all manner of former gifts grants bargains sails enfringements wills Intails Jointers
dowers Executions and incumbrances whatsoever only the Quiet rents over part and yearly hereafter
shall become due only excepted he the said Abraham Newkirk doth for himself his heirs Executors and
administrators do promise and engage that at any time hereafter at the reasonable request of him
the said William Farrior his heirs or assigns or his or their cost and charge in the Law make or
cause to be made and duely extend any further or other Deed or Instrument of Writing to the same
Making the Title of Land and premises to him the said William Farrior his heirs or assigns his or
theirs councel Learned in the Law shall advse Devise or Require and furthermore the said Abraham
Newkirk doth hereby covenant and agree for himself his heirs or Executors and administrators to
and with the said William Farrior his heirs and assigns to warrant and forever Defend the Title
of the said 100 acres of Land and premises to him the said William Farrior his heirs and assigns
free from the Lawfull Claim of the said Abraham Newkirk his heirs Executors and administrators or
any person or persons whatsoever. In witness whereof the said Abraham Newkirk have hereunto set
his hand and fixed his seal this day and Date above written.
